Understanding Conveyance Deed

A Conveyance Deed is a legal document through which the builder/developer transfers the title and ownership of land, building, and common amenities to the housing society. This is a crucial step that gives the society complete control and ownership of the property.

As per the Maharashtra Ownership Flats Act (MOFA), builders are legally required to execute a conveyance deed in favor of the society. However, many builders delay or refuse this process, which is where deemed conveyance comes into play.

What is Deemed Conveyance?

Deemed Conveyance is a legal remedy available to housing societies when the builder/developer refuses to execute the conveyance deed. Under Section 11 of MOFA, societies can approach the Competent Authority to obtain deemed conveyance, which has the same legal effect as a regular conveyance deed.
